Desde 11 de agosto de 1827, quando foram criados os primeiros cursos de Direito no Brasil, os advogados brasileiros comemoram a data que, com o passar do tempo, passou a ser conhecida simplesmente como o Dia do Advogado.

A atividade profissional da advocacia é tão importante no contexto de um Estado Democrático de Direito e numa forma republicana de governo que é a única profissão liberal mencionada na Constituição Federal. Está lá, na Seção III, do Capítulo IV, que versa sobre as “funções essenciais à Justiça”, e abrigada num artigo só seu (art. 133), que proclama: “O advogado é indispensável à administração da justiça, sendo inviolável por seus atos e manifestações no exercício da profissão, nos limites da lei”. A mesma Constituição traz ainda em seu art. 5º, um dos dispositivos mais essenciais de seu texto, a prestação de assistência jurídica integral e gratuita, pelo Estado, a todos aqueles que comprovarem insuficiência de recursos como um direito fundamental da cidadania (inc. LXXIV).

Uma nação forjada nas lutas pelas liberdades percebe desde logo a real importância da Justiça na experiência histórica da humanidade. E, por conta disso, reconhece o papel do advogado na linha de frente da defesa e garantia dos direitos dos cidadãos. São os advogados os responsáveis por manter íntegros os ideais de igualdade, liberdade, respeito, equidade e solidariedade; ideais estes capazes de construir, entre nós, a responsabilidade pelo mundo compartilhado em todos os níveis, em todas as áreas e em todos os setores da vida em sociedade.

É por isso que este dia, para muito além das homenagens à advocacia brasileira, é também o dia de reafirmarmos a importância das nossas prerrogativas profissionais, especialmente o fato de que, longe de serem meros privilégios, refletem diretamente o sistema constitucional de direitos e garantias fundamentais.

No intuito de bem compreender o real valor das prerrogativas profissionais da advocacia no contexto de uma nação livre e que respeita os cidadãos, é sempre bom lembrar que um Estado Democrático de Direito repousa exatamente no perfeito equilíbrio entre o poder do Estado e os direitos e garantias dos cidadãos. Para garantir esse equilíbrio, a nossa Constituição e todo o arcabouço legislativo brasileiro trazem inúmeros mecanismos e instrumentos habilitados à contenção dos excessos de poder pelo Estado. É nesse ponto, como instrumento de contenção dos excessos do poder, que estão, em lugar destacado, as prerrogativas profissionais da advocacia. Bem distante, portanto, da simples e indevida noção de privilégio, ao qual seguidamente tentam reduzi-las. As prerrogativas, portanto, não são simples direitos, mas verdadeiros deveres dos quais nenhum profissional está autorizado a abrir mão.

E o advogado, com a força e a coragem de sempre, jamais poderá abdicar do seu papel de defensor da cidadania: é seu dever enfrentar todos os desafios e suplantar todos os obstáculos no dia-a-dia de sua missão.

A todos estes corajosos e incansáveis colegas defensores da Justiça e da boa aplicação das leis, que se destacam nesta profissão tanto pela nobreza que apresenta quanto pelas virtudes que exige e pela responsabilidade que impõe a todos nós, os nossos mais efusivos cumprimentos!
